1. Introduction
Welcome to Rod Cage Photography ("we," "our," "us"). By accessing or using our website Rod Cage Photography, you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your use of our Site and services, including corporate headshot photography, personal branding photography, and related services ("Services"). If you do not agree with these Terms, please do not use our Site or Services.
2. Services
We provide professional photography services including but not limited to corporate headshots, personal branding portraits, and other related services. All Services are subject to availability and may be modified or discontinued at our discretion.
3. Booking and Payment
To secure our Services, a non-refundable deposit of 50% of the total fee is required at the time of booking. The remaining balance is due on the day before the Photoshoot or session. Payments must be made in Australian dollars (AUD) and can be processed through various methods, including credit cards and bank transfers. All payment details and instructions will be provided upon booking confirmation. Failure to make the remaining payment by the specified date may result in delays or cancellation of the Service.
Usage Licence and any third party fees negotiated by the Photographer are payable regardless of whether Licensed Images are in fact used by the Client or the Advertiser.

Cancellation by Client: If you wish to cancel a booking, you must notify us in writing as soon as possible. If you cancel the shoot within 7 days of the scheduled date, you will forfeit the 50% deposit paid at the time of booking. Additionally, if the remaining balance has already been paid, you will forfeit that amount as well.
Cancellation by photographer: photographer retains the right to cancel the shoot at any point, with all Client fees being refunded
Refunds: Refunds are not generally provided for Services rendered. If a refund is deemed necessary, it will be processed in accordance with the terms specified in your booking agreement.
5. Intellectual Property
All images and content produced by us are our intellectual property. You are granted a license to use the images for personal or professional purposes as agreed upon in your booking contract. Unauthorised use, reproduction, or distribution of the images is prohibited.
6. Client Responsibilities
You are responsible for ensuring that any content or materials you provide to us do not infringe on any third-party rights or violate any laws. You must also ensure that you have the necessary permissions for any locations or property used during the photography session.
Credits: In respect of all editorial uses and otherwise as additionally stated in the Estimate the Client shall procure that the Photographer’s name is printed on or in reasonable proximity to all published reproductions of the Licensed Images.
7. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of our Site or Services. Our total liability for any claim related to our Services is limited to the amount paid by you for the specific Service that gave rise to the claim.
Force Majeure
The Photographer shall not be liable for any failure or delay in the performance of any of such party’s obligations under these Terms caused by any circumstances beyond such party’s reasonable control.
8. Privacy and Data Protection
We are committed to protecting your privacy. Any personal information collected will be used in accordance with our Privacy Policy [link to Privacy Policy], which complies with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of NSW, Australia. Any disputes arising from these Terms or your use of our Site or Services will be subject to the exclusive jurisdiction of the courts in that State.

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our Site. Your continued use of our Site or Services following any modifications constitutes your acceptance of the updated Terms.
